Outdoor advertising – proposed new by-law

The Municipality of Cape Town is presently engaged in a process of public hearings with respect to a proposed new by-law regulating outdoor advertising. Meetings were held at the Cape Town Civic Centre on 22 and 23 October 2009. A particularly harsh and draconian aspect of the proposed by law is the fact that it seeks to outlaw transit advertising. Transit advertising is, in essence, advertising using purpose built trailers. Such trailers are typicall towed by vehicles around on public roads or, alternatively, parked at strategic areas. In many instances, these are public areas.
The transit advertising industry have recently formalised the industry by forming an association of the role players in the the greater Cape Town Metropolis. The association seeks to, amongst other things, regulate the industry and to engage the City on matters of mutual interest.
The assocation has lodged a public objection to the proposed new by-law insofar as the by-law seeks to outlaw its industry. Randall Titus & Association has been instructed to act on behalf of the association in its bid to compel the City to adapt its by-laws in order to ensure the continued existence of the outdoor transit advertising industry. This matter is presently ongoing and developments will be report as these arise.
